Terms of Use

1. Purpose and acceptance
These Terms of Use set out the rules for accessing and using the COCOON MIND service ("the Service"). By creating an account or using the Service, you fully accept these terms. If you refuse them, you may not use the Service.
2. Description of the Service
COCOON MIND is a personal tutor based on artificial intelligence, offering learning through curiosity: conversations with L'Élan (including by voice and image analysis, such as Le Scribe and La Chambre noire), the Constellation, the Epiphany Journal and personalised narratives (retrospectives, "memory" reminders); AI-generated curiosity tools such as The Two Paths (two AIs with opposite temperaments debating a question), The Idea Bridge, The Analogy Machine, On This Day in History, Two Truths and a Lie, the Etymology of the Day, the Living Timeline, the Knowledge Treasure Hunt and The Rabbit Hole (curiosity-to-curiosity exploration where each answer opens new doors, with the ability to save your trail) and The Compass of the Unexpected (a curiosity engine that surfaces unexpected questions from different angles — why, how, what if… — based on a subject you choose, each question being explorable further in a new conversation with L'Élan); logic games; audio podcasts, conferences, a screensaver, playful touches (welcome gift, anniversary); public explorer profiles and community interactions (sparks, following other explorers); a referral programme and personalised share cards (see Article 7); and real-time community spaces (The Vigil, The Circle, The Duo, The Arena, live chat), within which your first name or nickname and, if you have added one, your profile photo are visible to other participants. The Service is provided for intellectual exploration and the joy of learning. Certain features are subject to paid subscriptions ("Le Souffle" free, "L'Élan", "Le Cocoon"), the financial terms of which are governed by the Terms of Sale; payments are processed by our secure payment provider Stripe. The "Le Cocoon" subscription includes a Family Account allowing you to create up to five (5) independent explorer profiles within a single household, each with its own Thread of curiosity; these profiles are not password-protected and remain under the responsibility of the account holder.
3. Account and security
Access to certain features requires creating an account. You are responsible for keeping your credentials confidential and for all activity carried out from your account. You undertake to provide accurate information.
4. Minimum age and parental consent
The Service is open to people aged at least 15. Below the age of 15, use requires the prior, verifiable consent of the holder of parental authority, in accordance with Article 8 of the GDPR. By using the Service, you declare that you meet this age requirement or have obtained such consent.
5. Acceptable use
You undertake to use the Service fairly and respectfully. The following are prohibited in particular: hateful, harassing, defamatory, violent or discriminatory remarks; illegal content, sexual content involving minors, or content infringing the rights of third parties; spam, impersonation, collecting others' data, or any attempt to circumvent the Service's security.
6. User-published content and moderation
You remain responsible for the content you publish or post: community spaces (The Vigil, The Circle, The Arena, live conference chat, public contributions) and images you import for the vision features (Le Scribe, La Chambre noire). You undertake not to include any sensitive personal data. You grant COCOON MIND a non-exclusive licence to display this content within the Service. COCOON MIND reserves the right to moderate, hide or remove any content contrary to these Terms, and to suspend infringing accounts. Any abuse can be reported to contact@cocoonmind.com.
7. Referral programme and sharing
The Service offers a referral programme: each explorer has a personal link and code (based on their nickname) to invite other people. A validated referral may entitle you to a free subscription period (for example one month), and reaching a certain number of referees confers "Ambassador" status. To make sharing easier, the Service can generate personalised visuals (square or "story" format cards) featuring your first name or nickname, a short message and a QR code pointing to your referral link; their distribution is entirely at your own initiative. You undertake to use this programme fairly: in particular, creating fake accounts, self-referral, spam and any scheme intended to unduly obtain rewards are prohibited. COCOON MIND reserves the right to cancel rewards obtained abusively and to modify, suspend or close the programme at any time.
8. AI-generated content
L'Élan's responses and the generated content (text, synthetic voice, voice and image transcriptions, illustrations, personalised narratives, conferences) are produced by artificial intelligence and may contain inaccuracies or errors. They are provided for informational and educational purposes and in no way constitute professional, medical, legal, psychological or financial advice.
9. Intellectual property
The elements of the Service (the COCOON MIND brand, interface, texts, graphics, code) are protected and remain the property of the publisher. Any unauthorised reproduction or use is prohibited.
10. Suspension and termination
COCOON MIND may suspend or terminate a user's access in the event of a breach of these Terms, without prejudice to any remedies. You may delete your account at any time from your profile.
11. Liability
The Service is provided "as is". COCOON MIND cannot be held liable for decisions made on the basis of generated content, nor for interruptions due to maintenance, third-party providers or force majeure.
12. Changes to the Terms
COCOON MIND may amend these Terms at any time. Users will be informed of substantial changes; continued use constitutes acceptance of the version in force.
13. Governing law
These Terms are governed by French law. Any dispute will be subject to an attempt at amicable settlement before any legal action before the competent courts.
